Divorcing in China when the marriage was registered in France
A registered prenuptial agreement can reverse the entire analysis, and it is the first thing to check rather than an afterthought.
A couple married in Lyon; the client assumes community property applies, not realising that a prenuptial agreement switched them to separation of property.
Confirm from the notarial register which regime actually applies before forming any view on entitlement.
The position in one paragraph
A registered prenuptial agreement can reverse the entire analysis, and it is the first thing to check rather than an afterthought.
France's default is community of acquisitions, but a prenuptial agreement registered with the notary displaces it entirely. Because the change is registered rather than merely agreed, it is verifiable — and it can convert an expected half-share into no share of the other spouse's assets at all.
A typical situation
A couple married in Lyon; the client assumes community property applies, not realising that a prenuptial agreement switched them to separation of property.
Advising on the default without checking the register. The register is decisive, and the difference in outcome is not marginal.
What distinguishes this from a purely domestic case
The default regime is community of acquisitions, but a prenuptial agreement can switch the couple to separation of property — which changes everything.
On the China side, the connecting factor has to be established on the documents: A Chinese court can hear the case where the dispute has a genuine China connection: a party's Chinese nationality, domicile or habitual residence; the place of marriage registration; or property, accounts, equity or evidence located in China.
The practical sequence in a France-connected matter
- Confirm the China connection and choose the court with jurisdiction
- Serve the other party, or establish that service by public notice is necessary
- Authenticate and translate the foreign marriage documents and any foreign order
- Decide whether to seek a judgment or, more commonly, a mediated settlement
Certification differs between judicial documents and notarial documents, so the document type has to be identified first.
How France documents are handled
Apostille from the court or chamber of notaries for judicial documents, or the prefecture.
France uses a communauté system with a well-developed prenuptial agreement practice, and the chosen regime governs the division.
The default community-of-acquisitions regime applies only if no registered agreement displaced it.
What has to be decided before filing
Confirm from the notarial register which regime actually applies before forming any view on entitlement.
The boundary to plan around is this: A Chinese court cannot directly enforce orders over real estate or accounts located outside China; those assets need a separate step where they sit. Where value sits in France — typically property, company equity, assurance-vie policies — it is handled by agreement or by a separate route there, not by an order the Chinese court could enforce directly.
If your situation has a France element
If you are not sure whether your marriage gives a Chinese court jurisdiction, send us the country of registration, where each party lives now, and where the assets sit — we will tell you which court, if any, can hear it.
