Quick answer
What this page answers
Divorcing in China when the marriage was registered in the United Kingdom

England and Wales, Scotland and Northern Ireland are three separate systems, and which one made the order affects everything downstream.

The specific situation
The facts this usually involves

A couple married in Scotland, later settled in Beijing, and are now divorcing. One party has obtained advice about English family law.

The first thing to do
Where to start in practice

Identify the jurisdiction within the UK that governs the finances, before forming any view on what the outcome should be.

The position in one paragraph

England and Wales, Scotland and Northern Ireland are three separate systems, and which one made the order affects everything downstream.

Scottish and English family law differ in both property division and procedure, so advice given on the English position may not describe the Scottish one. Establishing which jurisdiction would actually have dealt with the finances is the first question, not an administrative detail.

A typical situation

A couple married in Scotland, later settled in Beijing, and are now divorcing. One party has obtained advice about English family law.

Treating 'UK law' as a single body of law. The assumption is common and it leads to wrong expectations about entitlement.

What distinguishes this from a purely domestic case

England and Wales apply the Matrimonial Causes Act framework, with wide discretion in financial remedy orders; Scotland and Northern Ireland differ.

On the China side, the connecting factor has to be established on the documents: A Chinese court can hear the case where the dispute has a genuine China connection: a party's Chinese nationality, domicile or habitual residence; the place of marriage registration; or property, accounts, equity or evidence located in China.

The practical sequence in a United Kingdom-connected matter

  1. Confirm the China connection and choose the court with jurisdiction
  2. Serve the other party, or establish that service by public notice is necessary
  3. Authenticate and translate the foreign marriage documents and any foreign order
  4. Decide whether to seek a judgment or, more commonly, a mediated settlement

FCDO legalisation is comparatively quick; translation and any certified copying usually take longer than the Apostille itself.

How United Kingdom documents are handled

Apostille issued by the Foreign, Commonwealth & Development Office (FCDO). No Chinese consular legalisation is then required.

The Apostille certifies the signature and capacity of the official, not the content of the document; a certified copy may be needed if the original must be kept.

A decree absolute needs to be the final version — a conditional order is not sufficient for a Chinese filing.

What has to be decided before filing

Identify the jurisdiction within the UK that governs the finances, before forming any view on what the outcome should be.

The boundary to plan around is this: A Chinese court cannot directly enforce orders over real estate or accounts located outside China; those assets need a separate step where they sit. Where value sits in United Kingdom — typically London property, company equity, joint accounts, pensions — it is handled by agreement or by a separate route there, not by an order the Chinese court could enforce directly.

If your situation has a United Kingdom element

If you are not sure whether your marriage gives a Chinese court jurisdiction, send us the country of registration, where each party lives now, and where the assets sit — we will tell you which court, if any, can hear it.

In UK-connected matters it is worth establishing at the outset which jurisdiction within the UK would deal with the finances, because English, Scottish and Northern Irish law produce materially different outcomes on the same facts.

Frequently asked questions

Does it matter where in the UK we married?
Yes. The three jurisdictions have separate courts and separate rules, and the difference affects property division as well as procedure.
Is a UK divorce recognised in China?
Not automatically. It requires a separate recognition application to a Chinese court.
Can I obtain a UK decree while living in China?
The procedural requirements differ by jurisdiction, and the residency tests matter. This should be checked before a petition is filed.
Which United Kingdom document should be dealt with first?
A decree absolute needs to be the final version — a conditional order is not sufficient for a Chinese filing. In practice the document that takes longest to obtain should be started first, not the one that is easiest to list.
Do you accept a matter with no connection to China?
No. The team only acts where the matter has a connection to China — a party's Chinese nationality, domicile or habitual residence, a marriage registered in China, or property, accounts, equity or evidence located in China. Purely foreign disputes are not accepted.
Do you accept a matter with no China connection?
No. We only act where the matter has a China connection: a party in China or holding Chinese nationality, domicile, habitual residence or identity documents, or property, a company interest, evidence, a document or an enforcement step located in or directed at China. Where everything — the parties, the assets and the documents — sits outside China and no Chinese court or authority needs to act, a lawyer in that jurisdiction is better placed to help and we would not be the right firm.
