Divorcing in China when the marriage was registered in the United States
State-versus-federal confusion is the defining feature of US-connected matters: the same marriage can generate documents from two different certification systems.
A couple married in California, now living in Shanghai and New York. One party wants a Chinese divorce; the other has already consulted a US attorney about filing in California.
Before filing anywhere, establish which court will finalise status first, and whether the other jurisdiction will recognise that outcome. In practice this usually means a short written sequencing plan rather than two lawyers working independently.
The position in one paragraph
State-versus-federal confusion is the defining feature of US-connected matters: the same marriage can generate documents from two different certification systems.
Two parallel proceedings are not necessarily a problem — but they must be sequenced. If a US court finalises the divorce first, the China route changes from 'divorce' to 'recognition', which is a different application with different evidence requirements. Deciding which route to lead with is the first decision, not the last.
A typical situation
A couple married in California, now living in Shanghai and New York. One party wants a Chinese divorce; the other has already consulted a US attorney about filing in California.
Filing in China while a US divorce is pending can produce two conflicting marital-status determinations. The court will ask about the US proceedings, and an incomplete answer at that point is difficult to correct later.
What distinguishes this from a purely domestic case
US courts apply state law to marital property, and community-property states (California, Texas) treat property very differently from common-law states.
On the China side, the connecting factor has to be established on the documents: A Chinese court can hear the case where the dispute has a genuine China connection: a party's Chinese nationality, domicile or habitual residence; the place of marriage registration; or property, accounts, equity or evidence located in China.
The practical sequence in a United States-connected matter
- Confirm the China connection and choose the court with jurisdiction
- Serve the other party, or establish that service by public notice is necessary
- Authenticate and translate the foreign marriage documents and any foreign order
- Decide whether to seek a judgment or, more commonly, a mediated settlement
The state-level split means two documents from the same marriage can need certification in two different offices.
How United States documents are handled
Apostille. A state-issued document (marriage certificate, state court order) is certified by the state Secretary of State; federal documents go through the US Department of State.
The most common failure is sending a county-issued marriage certificate for the wrong level of certification. Confirm which office issued it first.
A state marriage certificate is authenticated by the Secretary of State, while federal documents go through the US Department of State — mixing them up is the single most common error.
What has to be decided before filing
Before filing anywhere, establish which court will finalise status first, and whether the other jurisdiction will recognise that outcome. In practice this usually means a short written sequencing plan rather than two lawyers working independently.
The boundary to plan around is this: A Chinese court cannot directly enforce orders over real estate or accounts located outside China; those assets need a separate step where they sit. Where value sits in United States — typically property in California or New York, LLC and corporate equity, brokerage accounts, 401(k) plans — it is handled by agreement or by a separate route there, not by an order the Chinese court could enforce directly.
If your situation has a United States element
If you are not sure whether your marriage gives a Chinese court jurisdiction, send us the country of registration, where each party lives now, and where the assets sit — we will tell you which court, if any, can hear it.
One practical note for US-connected matters: because state and federal documents follow different certification routes, it is worth checking the issuing office for each document before deciding which to order first. Getting that wrong is the most common reason a filing is returned rather than accepted.
