Recognising a Korean divorce in China

Korean divorces reached by agreement and by court decision take different documentary forms, and the recognition application needs the right one.

The specific situation
The facts this usually involves

A couple divorced in Korea by agreement, and the client needs that recorded in China to deal with Chinese property.

The first thing to do
Where to start in practice

Provide the registration documents together with a clear account of the Korean procedure, translated.

The position in one paragraph

Korean divorces reached by agreement and by court decision take different documentary forms, and the recognition application needs the right one.

An agreed divorce in Korea is registered administratively rather than decided by a court, and the resulting document is different in kind from a judgment. A Chinese court assessing recognition will want to understand the procedure that produced it, including whether both parties participated.

A typical situation

A couple divorced in Korea by agreement, and the client needs that recorded in China to deal with Chinese property.

Applying with the registration record alone and no explanation of the procedure. The court has to be satisfied that the process was genuine and both parties were involved.

What distinguishes this from a purely domestic case

Korean law recognises a separate-property principle with a claim for contribution to marital assets, which differs materially from the Chinese position.

On the China side, the connecting factor has to be established on the documents: Recognition is a separate application to a Chinese intermediate court; the foreign decree does not take effect in China simply because it exists.

The practical sequence in a South Korea-connected matter

  1. Check whether the foreign decree is final and whether the foreign court had a proper basis for jurisdiction
  2. Confirm that the other party was properly served in the foreign proceedings, as this is the most common ground of refusal
  3. Authenticate and translate the decree and the supporting court documents
  4. Apply to the intermediate court with jurisdiction over the applicant's residence or the property concerned

Certain Korean documents require a prior certification before the Apostille is issued, which adds a step that is easy to miss.

How South Korea documents are handled

Apostille from the Korean Ministry of Foreign Affairs; certain documents require a prior certification by another authority.

The family relations register (ga-jok gwan-gye deung-rok bu) matters more than the marriage report, and it must be a recent certified extract.

The family relations register is a live record of status, so an old copy is not accepted.

What has to be decided before filing

Provide the registration documents together with a clear account of the Korean procedure, translated.

The boundary to plan around is this: Recognition changes marital status in China. It does not by itself divide China-situated property or settle custody. Where value sits in South Korea — typically real estate, jeonse deposit funds, small business interests — it is handled by agreement or by a separate route there, not by an order the Chinese court could enforce directly.

If your situation has a South Korea element

Most refusals come down to service and finality in the original proceedings. Send us the decree and we will tell you whether recognition is realistic before you file.

Frequently asked questions

Is an agreed Korean divorce recognisable in China?
It can be, but the court will want to understand the procedure and confirm both parties participated.
What about a court-ordered Korean divorce?
A judgment follows the more familiar recognition route and is generally more straightforward.
What documents are needed?
The record of the divorce, evidence of the parties' participation, and authenticated translations.
Which South Korea document should be dealt with first?
The family relations register is a live record of status, so an old copy is not accepted. In practice the document that takes longest to obtain should be started first, not the one that is easiest to list.
Do you accept a matter with no connection to China?
No. The team only acts where the matter has a connection to China — a party's Chinese nationality, domicile or habitual residence, a marriage registered in China, or property, accounts, equity or evidence located in China. Purely foreign disputes are not accepted.
Do you accept a matter with no China connection?
No. We only act where the matter has a China connection: a party in China or holding Chinese nationality, domicile, habitual residence or identity documents, or property, a company interest, evidence, a document or an enforcement step located in or directed at China. Where everything — the parties, the assets and the documents — sits outside China and no Chinese court or authority needs to act, a lawyer in that jurisdiction is better placed to help and we would not be the right firm.
