A client suspects that funds, property or company interests have been transferred out of China ahead of a divorce, and wants to know what can be done.

When this situation arises

A client suspects that funds, property or company interests have been transferred out of China ahead of a divorce, and wants to know what can be done.

The usual sequence

  1. Apply for preservation over the China-situated assets that can be evidenced now, before completing the investigation
  2. Assemble the documentary trail: transfers, property records, corporate filings, and any communication indicating intent
  3. Where assets have gone abroad, plan the separate route in that jurisdiction rather than assuming a Chinese order will reach them
  4. Use the recorded trail as negotiating material, since that is frequently what produces the settlement

Where it usually stalls

The most common failure is sequencing: building a complete picture before applying for preservation. By then the remaining China assets may also have moved, and the practical leverage is gone.

What is realistically achievable

Recovery of assets already abroad is slow and uncertain. What is achievable is preservation of what remains in China, and a documented position that makes the transfer hard to deny in negotiation.

If your situation looks like this

Send the facts in one message: where the marriage was registered, where each party lives now, where any children are, and where the assets are held. That is usually enough to say whether a China route exists before any document is ordered, and there is no charge for that first review.
