Which court in China can hear a cross-border divorce?
Check nationality, residence, where the marriage was registered, China assets, China evidence, child arrangements, and whether a foreign document must be used in China.
Overseas real estate, offshore equity, foreign judgments, custody orders, service routes and authentication may each require a separate route rather than one combined order.
Documents formed abroad may also need translation, notarisation, Apostille or consular legalisation, and a power of attorney executed in the required form.
Jurisdiction rules in detail
Chinese jurisdiction in family matters with an overseas element turns on a small number of connecting factors. The most frequently used rules are:
- Defendant domiciled in China. An ordinary filing at the defendant's domicile.
- Identity-relation suits against a person who does not reside in China. The plaintiff's domicile (and where domicile and habitual residence differ, the plaintiff's habitual residence) may have jurisdiction — Article 23(1) of the Civil Procedure Law.
- Overseas Chinese (huaqiao) scenarios. Where the country of settlement declines jurisdiction because the marriage was registered in China, or because the suit must be brought in the country of nationality, the courts at the place of marriage registration, the parties' original domicile in China, or the last habitual residence in China may hear the case.
- One party in China, one abroad. A suit by either party can generally be brought at the domicile of the party living in China.
- Both parties abroad but not settled abroad. Jurisdiction generally lies at the plaintiff's or the defendant's original domicile in China.
- Non-identity matters (property, company interests). Since the 2023 amendment, Article 276 allows a Chinese court to take a case where the dispute has an "appropriate connection" with China, extending the older list of connecting factors.
Since 1 January 2024 the amended Civil Procedure Law also codifies parallel proceedings and the forum non conveniens principle, so the fact that a case has been filed abroad does not by itself prevent a Chinese court from hearing a matter within its jurisdiction.
Common mistakes that cost months
- Filing at the wrong level or location. A filing at a court without jurisdiction is transferred or dismissed, and where a party is abroad every step takes longer.
- Assuming a foreign filing blocks China. Since 2024 the amended law deals expressly with parallel proceedings, so the analysis is a comparison, not an automatic bar.
- Leaving service planning until after filing. What the file needs to prove about the other party's whereabouts should be established before the case is lodged.
Where jurisdiction shows up on the page
Jurisdiction is also an evidence question: the facts that give a Chinese court power are the same facts a lawyer must be able to prove on paper. A short, well-organised jurisdiction memo prepared before filing is usually worth more than any other preparatory step.
