Quick answer
When it applies
Start with the China court or China document need

Check nationality, residence, where the marriage was registered, China assets, China evidence, child arrangements, and whether a foreign document must be used in China.

Legal boundary
Cross-border matters usually need separate steps

Overseas real estate, offshore equity, foreign judgments, custody orders, service routes and authentication may each require a separate route rather than one combined order.

Prepare first
Organise identity, marriage, address, asset, evidence and authorisation records

Documents formed abroad may also need translation, notarisation, Apostille or consular legalisation, and a power of attorney executed in the required form.

Why mediation is the default starting point

Where both parties can be brought into a structured negotiation, a court mediation that ends in a mediation ruling gives the parties an enforceable Chinese instrument without the length and exposure of a contested trial. For overseas clients this matters disproportionately: a contested case with a party abroad runs into service timelines, translation of every filing, and hearing scheduling across time zones.

How Yuanjia structures this

Yuanjia's family team works with a mediation centre led by a retired judge with more than 30 years of mediation experience. The working method is bargaining with a litigation fallback: prepare the case as if it will be tried, and negotiate from that position. Where the other side refuses to engage, the file converts to litigation without restarting the preparation.

Frequently asked questions

Is a court mediation ruling as strong as a judgment?
A mediation ruling issued by a Chinese court is an enforceable legal instrument. Where a settlement is reached privately without court involvement, it does not automatically carry the same enforcement weight.
Can mediation work if my spouse is in another country?
It can. Mediation can be conducted with the other party participating remotely or through a representative, provided the required authorisation is in place.
Do we have to appear in person?
Not necessarily. Whether personal appearance is required for the specific step is decided by the court; remote participation is used in practice.
Do you accept a matter with no China connection?
No. We only act where the matter has a China connection: a party in China or holding Chinese nationality, domicile, habitual residence or identity documents, or property, a company interest, evidence, a document or an enforcement step located in or directed at China. Where everything — the parties, the assets and the documents — sits outside China and no Chinese court or authority needs to act, a lawyer in that jurisdiction is better placed to help and we would not be the right firm.
